A Bozeman man charged with felony aggravated assault after a July brawl that hospitalized a man the night before his wedding is now facing a misdemeanor.

Eric Charles Homec, 22, pleaded not guilty in October to misdemeanor assault after the county attorney’s office dismissed the felony charge, according to court records.

Homec was a walk-on junior defensive end on the Montana State University football team last winter but voluntarily left the team in the spring.

Bozeman police told the Chronicle in July that Homec and Daniel Schotthoefer, 30, got into a fight outside a bar on the 300 block of East Main Street sometime before 1:45 a.m. on July 15. When police arrived, they found two men injured on the ground and two others walking away.
Witnesses told police Homec stomped on Schotthoefer’s head with his heel two to three times, Bozeman police officer Brandon Olson said at the time.

Schotthoefer sustained a skull fracture and “bleeding on the brain,” Olson had said, and Homec had a broken jaw.

Both men were taken to Bozeman Deaconess Hospital. But Schotthoefer was later taken to Billings for treatment.

Attorneys later learned that Schotthoefer instigated the altercation and there were others involved, said Al Avignone, Homec’s attorney.
“The evidence shows that the alleged victim attacked and physically assaulted Mr. Homec first, and he physically assaulted him repeatedly before Mr. Homec defended himself,” Avignone said last week. “Mr. Homec was simultaneously being physically assaulted by several other people at once, so he defended himself. I believe the misdemeanor charges are the more appropriate charges based on what happened out there.”

According to Gallatin County Justice Court documents, Schotthoefer is seeking nearly $40,000 in restitution.

Homec is free on $30,000 bond and has been ordered not to contact Schotthoefer. If convicted, Homec could be sentenced to six months in jail, a $500 fine or both.
